Privacy information pursuant to Reg. UE 2016 / 679 (GDPR) and to Italian D.LGS 101/18  (Privacy Code) and legal notes

This document intends to describe as accurately as possible the privacy policies in the management of the processing of personal data processed by Porta & Consulenti Associati S.p.A. (in short PCA) and related to customers, suppliers, subscribers to our mailing lists, as well as personal data of users and visitors of the our site and, in general, all the subjects with whom we maintain working relations.
The information is not valid for other websites that may be consulted through our links, for which PCA is in no way responsible.

Processing Owner

Porta & Consulenti Associati S.p.A. (in short PCA), based in Via Vittoria Colonna, 4 -20149 -MILANO, is the “Holder” of the processing of personal data collected following a request for advice or service on Industrial Property or with the consultation of our site and any other data used for the provision of our services, and more generally, of any personal data treated by us.
Rights of the interested parties

The Interested person,
pursuant to art. 7 of the Privacy Code, and of art. 15-22 of GDPR, have the right at any time to obtain confirmation of the existence or otherwise of the same data and to know its content and origin, verify its accuracy or request to integrate, get a structured and portable copy, limit the processing, update, correct or obtain cancellation from our archives, transformation into anonymous form or blocking of data processed in violation of the law, and to oppose in any case, for legitimate reasons, to their treatment. The related requests must be addressed to the same PCA whose addresses are indicated in the chapter “Place and purpose”.
Pursuant to articles 11 and 12 GDPR the reply to a request relating to the processing of data will be communicated within one month from the day following the request, which can be extended up to three in case of complexity.

The Interested person has furthermore the right to complain before a Control Authority

Place and purpose
The treatments connected to the web services offered by this site as well as the processing of personal data relating to customers, suppliers, subjects registered in our mailing lists, and, in general, all the subjects with whom we maintain working relations are carried out at the headquarters of PCA, located in:

and are taken care of by employees, partners, collaborators of PCA educated and appointed as data processors, or by persons in charge of occasional maintenance operations of electronic and IT equipment; the physical location of the data may be on electronic supports relocated and stored with security criteria on behalf of PCA.

The personal data provided by users who forward service requests, as well as by customers, suppliers and persons subscribed to our mailing lists and, in general, all the subjects with whom we maintain working relations are used in order to perform the service or the required service (consultancy in Industrial Property and related servants, in Italy or abroad), in order to fulfil contractual or legal obligations, and may be disclosed to external parties in charge of performing services abroad also on the basis of the assignments specific data received as examples: subjects in charge of providing advice on legal and contractual matters, IT consultancy companies (only within the limits of needs arising from the operation of computer programs and procedures), tax advisors and auditors of the company, charged with carrying out the credit recovery. In any case, said personal data are not disclosed to other third parties, unless the communication is imposed by legal obligations or is strictly necessary for the fulfilment of contractual obligations. The faculties of the interested party are valid for all purposes (see above).
It should be emphasized that the members of the Reel of Industrial Property Consultants must in any case operate in a confidential manner with respect to what is communicated to them by the Customers (Article 206 of the CPI) and it is specified that any industrial secrets are only handled by the PCA staff or by foreign correspondents necessary for the accomplishment of professional activity, equally bound to secrecy according to the regulations of their countries.

KIND OF PROCESSED DATA
Navigation data

The computer systems and software procedures used to operate the website http://www.pcapatlaw.it acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.
This is information that is not collected to be associated with identified interested parties, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users connecting to the site, the addresses in the Uniform Resource Identifier (URI) notation of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (success, error, etc.) and other parameters relating to the operating system and the user’s computer environment. These data are used for the sole purpose of obtaining anonymous statistical information on the use of the site and to check its correct functioning and are deleted immediately after processing. The data in question could be used to ascertain responsibility in case of any computer crimes against our site: apart from this possibility, data on web contacts are generally not stored for more than seven days.

Interested person’s data
The optional, explicit and voluntary sending of mail to the physical and electronic addresses of PCA involves, by its very nature, the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data included in the message. We invite our users, in their requests for services or their queries, not to send names or other personal data of third parties that are not strictly necessary.
The personal data processed by us are essentially aimed to identify the subject (name, surname address, postal addresses), but also other data possibly provided for the performance of the service of technical legal advice and, to them, the previous rules apply. However, please note that, under Italian law, we are required to keep a copy of the correspondence for ten years: therefore, the right to cancellation concerns the deletion of a personal data useful for future contact, but cannot include the correspondence that remains kept in the archive. Furthermore, it should be noted that the management of information on legal entities may involve the acquisition of data relating to physical persons connected to them. For all the categories of interested parties (customers, suppliers, subjects subscribed to our mailing lists, users of the site and, in general, all the subjects with whom we work) the provision of their personal data is optional, but the failure to provide it may make it impossible to follow up the agreements made or to conclude the contract or provide the requested service. Personal data can also be collected from public online databases and from private databases that get information from public sources, but which are always related to Intellectual Property matters (Trademarks, Patents, Designs, domain names), mainly names and postal addresses of holders/licensees, or data available in public Company Registers and the like.

Processing methods and data transfer
Personal data are processed in paper format and / or with automated tools. PCA may transfer data to the following categories of addressees, authorized by this directly or by Clients through a Power of Attorney, exclusively to achieve the purposes for which they have been collected (protection of Industrial Property) and to observe the legal obligation to keep correspondence for 10 years:  consultants and professionals – alone or associated,- banks or lenders, Italian or European public bodies.

Since the legal technical advice provided by PCA is of an international nature, personal data may be transferred to correspondents (IP or legal consultants) and foreign bodies (Patent Offices, bodies for the reassignment of Domains)  in Approved States in appropriate and non-eligible States. but they are still available from these subjects.
Specific security measures are observed to prevent data loss, illicit or incorrect use and unauthorized access.

Cookie
In the case of access to our website, remember that for cookies we mean a text element that is inserted into the hard disk of a computer only after authorization. If you agree, the text is downloaded to a small file. Cookie have the function to streamline the analysis of traffic on the Web or to signal when a specific site is visited and allow Web applications to send information to individual users. No personal data of users is acquired by the site in this regard.

If you download any type of material from our site, you do so at your discretion and at your own risk. No notice or information, written or oral, obtained by you from PCA or from our site may represent any form of guarantee.

Access to external websites connected
Within the site you may find links (links) to other sites, some of which are reported by PCA and others from different managers. These links have been inserted to provide you with a service and an additional way to access the information contained in the various sites. PCA has no responsibility for the contents of external sites, which can be accessed via links located within PCA provided as a simple service to network users. The sites of the managers other than us can contain information on which PCA may or may not agree. The presence of links to other sites should not be interpreted as an approval of the content of the sites accessed.
