A new and stricter Chinese Trademark Law will apply starting in January 2027. Among the significant changes:
– The opposition period will be shortened from three months to two months.
– The Office itself (CNIPA) will be able to initiate revocation actions for non-use after three years, or declare that a trademark has become vulgarized.
– CNIPA will be able to rectify allegedly misleading trademarks and impose fines on both the owner and the Office’s examiners (rejections on the grounds that trademarks are misleading will likely increase).
– Proceedings may be suspended (e.g., oppositions) pending the official conclusion of other proceedings.
– Fines will apply to those who file in bad faith.
– Fines will apply to those who fail to update the Register following a change of name or registered office.
– Multimedia trademarks will be eligible for registration.
