December 29, 2022 is the date of entry into force of the regulation which allows for the presentation of trademark nullity or forfeiture actions before the Trademark Office (UIBM). It will always be possible to act in Court, as it has been up to now, but it is expected that the new administrative procedure – if it proves to be more streamlined, as well as cheaper (the owners may also be represented by trademark Attorneys) – will be particularly appreciated by users, especially by the one relating to revocation actions for non-use.
Therefore, it is recommended to urgently verify your registrations at risk of forfeiture due to non-use (use never started more than 5 years after the first registration or ceased more than 5 years after the last use) and start use as soon as possible or consult the Trademark Attorneys to evaluate how to protect yourself.
